Dallas Home Health Agency Sued for Pregnancy Discrimination

Your Health Team, a home health agency in Dallas, has been sued for pregnancy discrimination. The Equal Employment Opportunity Commission (EEOC) has filed the suit on behalf of Zanna Clore, an employee that was fired due to her pregnancy. The lawsuit is moving forward after the EEOC and Your Health Team failed to reach a settlement outside of court.

The suit alleges that Your Health Team, upon learning of the woman’s pregnancy, required her to provide a doctor’s note. Clore complied by getting a release from her doctor which stated that she was fully capable of doing her job with the exception of lifting more than 25 lbs. However, despite having this release, the lawsuit claims that Clore was fired immediately after handing over the doctor’s note.

"This employer based its decision to abruptly end Ms. Clore's employment because of her pregnancy instead of focusing on whether she could continue to perform the key job duties during the period of her maternity," said the EEOC attorney on the case.

Unfortunately, pregnancy discrimination still happens quite often. This case is just one of almost 50 other pregnancy discrimination cases filed since 2011. These cases have resulted in over $3,500,000 in awards for the plaintiffs. The regional attorney for the EEOC Dallas District Office, Robert A. Canino, has said of the case that “as a society, we should have already evolved well beyond the old-school thinking that a pregnant worker must be excluded from the workplace.”
