A Texas car salesman is suing his boss’ dealership on the basis of disability discrimination in the workplace. Jimmy Lancaster worked at the Longview Toyota dealership. His battle with colon cancer left him with medical issues that made it so he required certain accommodations to do his job.

He says that in the past, the owner and management did a good job of accommodating his medical issues. For example, he was allowed to take frequent or unexpected breaks so that he could empty his colostomy bad. According to the suit, when the business changed hands, the new employer stopped providing reasonable accommodations.

According to Lancaster, the company eventually fired him because of his needs as a cancer survivor.

The Law Can Bring Justice for Victims of Disability Discrimination in the Workplace

Not all employers are required to abide by the Americans with Disabilities Act in the state of Texas, but all workers are still entitled to basic employment rights and privileges.

The law requires Texas employers to make reasonable accommodations, so that employees can perform their job responsibilities. This includes taking actions such as adding ramps for workers who use wheel chairs, and allowing people with medical challenges to adjust their schedules. The law also prohibits business for firing employees because of a disability.
