The Civil Rights Act of 1964 prohibits employers from using gender as the basis for making any employment decisions, including hiring, termination, promotion, compensation, or job training. Employers may not base decisions on stereotypes and assumptions of which gender may be more able to perform specific jobs or job duties.

In addition, employers cannot sexually harass employees or job applicants. Sexual harassment can include requests for sexual favors, unwelcome sexual advances, and other verbal or physical conduct that creates a hostile work environment.

Finally, employers cannot discriminate against employees on the basis of pregnancy.
