If you have a disability, you are entitled to certain workplace rights under the law, including freedom from discrimination, reasonable accommodation of your limitations to allow you to work, and access to appropriate medical leave, if necessary.

Disability discrimination in employment is prohibited by Title I of the 1990 Americans with Disabilities Act, or ADA. The ADA also obligates your employer to provide reasonable accommodation for your disability. The Family and Medical Leave Act (FMLA) gives you the right to up to six weeks of unpaid leave for medical reasons without threat to your job.

Reasonable accommodation means that the employer must modify or change the working environment to accommodate your disability. It also means the employer must provide reasonable accommodation to allow disabled workers to apply for jobs, and to provide equal pay and benefits.

Resolving Disability Accommodation Disputes

The most common disability rights issue affecting employees with disabilities is being unable to obtain necessary scheduling changes, adaptive equipment, and other accommodation for their limitations. Sometimes employers are reluctant to make any accommodation or do not understand how the law applies to them. Part of my responsibility in representing you is helping your employer understand the need to provide the necessary accommodation.

I can help you negotiate with your employer so you can come to an agreement on what will be necessary. If a certain option is too expensive or difficult for your employer to provide, I can help you seek an acceptable alternative. The key to reasonable accommodation is flexibility. Federal law also prohibits placing undue hardship on employers as well. If an agreement simply cannot be reached, I can help you pursue an ADA claim in court.
