Both employees and job applicants aged 40 and older are protected from discrimination on the basis of age by the federal Age Discrimination in Employment Act of 1967 (ADEA). According to the Equal Employment Opportunity Commission (EEOC) it is unlawful to discriminate against a person based on age regarding any "term, condition, or privilege of employment, including hiring, firing, promotion, layoff, compensation, benefits, job assignments, and training."
